TERMS OF USE OF THE WEBSITE AND
PROVISION OF SERVICES BY THE SHOWROOM

§1
General provisions
These Terms of Use set out the rules for using the website www.wzorcownia-gdansk.pl (the "Website") and for the provision of services by the showroom owned by Wzorcownia Gdańsk limited liability company, ul. Piastowska 32, 80-332 Gdańsk, Poland, tax ID (NIP): 5842735130, court register (KRS): 0001113626, statistical ID (REGON): 222060993 (the "Company").
The content of the Website is protected by industrial and intellectual property rights. All materials, photographs, logos and trademarks published on the Website are the property of the Company; their use, copying or distribution—particularly for commercial purposes or in the course of business—without the Company's prior consent is prohibited.
Services are provided at the physical showroom (the "Showroom") in Gdańsk at ul. Piastowska 32.
The Company makes these Terms available on the Website and at the Showroom.
§2
Conditions of use of the Website
All information about goods and services published on the Website is for illustrative purposes only and does not constitute an offer within the meaning of applicable law, in particular the Civil Code. Such information is not binding and may not form the basis of any claims against the Company, including claims for the conclusion of a contract of sale or for services.
The Company makes every effort to ensure that information on the Website is up to date, accurate and complete. At the same time, the Company is not liable for any lack of currency, accuracy or completeness of that information, nor for any errors that may appear in the content presented on the Website.
Where images of goods are shown on the Website, the Company reserves that they may differ from the actual appearance of the goods, in particular as regards colour, material texture or shape. The Company is not liable for the correspondence between the images of goods on the Website and reality.
The user bears full responsibility for any damage arising from use of the Website.
The Company may at any time and without prior notice make changes to the Website. Changes may concern any elements of the Website and take effect from the date of publication.
The Website collects information stored in cookies. Detailed rules concerning the processing of personal data collected through cookies are made available on the Website.

Conditions for the provision of services by the showroom
To conclude a contract for the sale of goods available from the Company's suppliers, the customer may request a quotation or place an order directly at the Showroom or by message to the e-mail address: ….. .
Sending a quotation request does not require registration in any system. The customer should provide contact details (first name, surname and e-mail address) and consent to the processing of the personal data provided for the purpose of preparing the quotation. The customer should receive a response to the request no later than within ____ of sending the request.
Final information on availability or price of goods from the Company's suppliers is given in the quotation prepared by the Company or in the order confirmation.
All orders placed by customers are individual and tailored to their specific, unique needs.
Goods that have been ordered and collected are not subject to exchange or return.
When placing an order, the customer is required to pay a deposit equal to 40% of the order value, to the Company's bank account no. 53 1160 2202 0000 0002 5899 70 28. The remainder of the order price is payable before collection of the goods, within 7 days of the date the Company issues and provides the final invoice to the customer. The customer authorises the Company to issue invoices in electronic form.
The order fulfilment period runs from the date the deposit referred to in section 6 above is credited to the Company's bank account. The Company reserves that, for objective reasons, the fulfilment period may be extended accordingly. Any extension of the fulfilment period does not change the order price.
For orders with a value above PLN 1,000.00, the Company provides free delivery comprising two deliveries to the address indicated by the customer within the Tricity (Trójmiasto) area and vicinity; this does not include unloading or carrying goods inside.
As additional services, the Company provides delivery for orders not exceeding PLN 1,000.00, and unloading or carrying goods inside. The terms of additional services are agreed individually with the customer each time.
For the duration of order fulfilment, the Company stores goods free of charge for a period not exceeding 2 months from completion of the entire order and issuance of the final invoice. After that period, further storage is available as an additional service at PLN 100.00 per pallet or PLN 300 per crate for each further month or part of a month.
§4
Final provisions
1. These Terms may be changed in whole or in part at any time without prior notice to users/customers. The new version is effective from the moment it is published on the Website.
2. The Company is liable to the customer if the goods are not in conformity with the contract. Complaints concerning differences in shade or dimensions of goods, in particular porcelain stoneware or ceramic tiles, will be considered only before they are installed/fixed.
3. The customer may submit a complaint in writing to the Company's address or by e-mail to: ............ . The complaint should state the customer's name and surname, correspondence address, type and description of the problem, and the request related to the complaint. If the complaint is incomplete, the Company will ask the customer to complete it within 7 days of receipt of the request, with a warning that failure to provide the necessary information will result in the complaint being left unprocessed. The Company will respond to the complaint within 14 days of receipt. If no response is given within that period, the complaint is deemed to have been accepted by the Company.
4. The Company declares that any disputes arising from users' use of the Website and from services provided by the Company, including the sale of goods, will in the first instance be resolved amicably.
§5
Privacy policy
Processing of personal data
1. The Company processes personal data of users/customers. Details are set out in the paragraphs below.
2. The controller of personal data of users/customers is Wzorcownia Gdańsk Spółka z ograniczoną odpowiedzialnością, ul. Piastowska 32, 80-332 Gdańsk, NIP: 5842735130, KRS: 0001113626, REGON: 222060993.
3. Personal data are processed for the following purposes:
- proper performance of a placed order and of the contract between the user/customer and the Company, on the basis of Article 6(1)(b) GDPR;
- possible establishment or pursuit of claims by the Controller or defence against such claims—on the basis of Article 6(1)(f) GDPR, where processing is necessary for the purposes of the legitimate interests of the Controller consisting in protecting its rights;
- analytics: tailoring services to users'/customers' needs; optimising services on the basis of users'/customers' feedback and service processes based on how services are delivered, which is a legitimate interest of the controller—on the basis of Article 6(1)(f) GDPR, as processing is necessary for the legitimate interest of the Controller consisting in presenting customers with information on products suited to their needs and interests and thereby increasing sales of those products (marketing purposes);
- archival (evidentiary) purposes to secure information in case of a legal need to prove facts, which is a legitimate interest of the controller (basis in Article 6(1)(f) GDPR).
4. Recipients of the user's/customer's personal data will include entities providing services related to the Company's current operations to which we are obliged to disclose data under applicable law (including competent tax authorities), entities providing courier or postal delivery, IT services, payment operators, accounting or advisory services.
5. Personal data will be stored:
- for the period of performance of the order and, after it ends, until the Company's obligation to archive documents related to the conclusion or performance of the contract ceases or mutual claims become time-barred (whichever occurs later);
- for the period necessary to respond to a quotation request or until other rights are exercised that result in cessation or restriction of processing, in particular until a request for erasure or—where processing is based on the Controller's legitimate interest—objection to processing.
6. In connection with processing, the user/customer has the right to:
- access their personal data and obtain a copy;
- rectification of personal data if, in the user's/customer's opinion, the data are incorrect;
- erasure of data;
- restriction of processing;
- object to processing based on legitimate interests for purposes other than direct marketing, and also where processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority (the user/customer should then indicate to the Company the particular situation which, in their view, warrants cessation of the processing covered by the objection; the Company will cease processing for those purposes unless it demonstrates that the grounds for processing override the user's/customer's rights or that the data are necessary for establishing, exercising or defending claims);
- data portability;
- lodge a complaint with a supervisory authority—the President of the Polish Personal Data Protection Office (UODO) or another competent supervisory authority;
- withdraw consent to processing (withdrawal does not affect the lawfulness of processing carried out before withdrawal).

8. As operator of the Website, the Company ensures the security of personal data through appropriate technical and organisational measures to prevent unlawful processing and accidental loss, destruction or damage.
9. Provision of data by the user/customer is a condition for the provision of services by the Company.
